Following the request of its client, a European producer of construction materials, M-Legal performed the procedure of debt collection with regard to its unscrupulous Russian customer.
A part of the debt was collected via prejudicial proceedings: by sending a pre-trial claim and signing a debt settlement agreement. However, the Russian customer failed to perform its payment obligations in full.
To recover the full amount of the debt, a litigation was started.
The lawyers of M-Legal have filed a claim to the State Arbitration Court of Moscow. The arguments of M-Legal have been completely supported by the judge, resulting in full debt enforcement and extra award of about 20% of the debt as penalties and compensation of costs.
